Recreational Immunity Bill Receives Hearing

Legislation restoring recreational immunity, along with bills expanding age discrimination and allowing striking workers to receive unemployment, received consideration this week. 

Specific developments include the following:

  • The Senate Judiciary Committee heard testimony on SB 179, which will permanently restore recreational immunity. The Legislature addressed this issue last session with a temporary measure after an adverse court ruling had weakened the protection land owners received against injury claims from recreators. SB 179 makes that temporary fix permanent. The bill is supported by the LOC and CIS. 
  • The House Committee on Labor and Workplace Standards held a public hearing this week on HB 3187 which would alter existing protections against age discrimination. The LOC testified against the bill, indicating the language would create confusion and the conduct is already prohibited. 
  • SB 916, which provides unemployment insurance for striking workers, was the subject of an informational meeting in which Senate Labor Committee members asked questions of the Oregon Employment Department. Additionally, lobbyists representing management offered concessions on the bill during negotiations, but were rebuffed. The LOC continues to urge city leaders to contact their state senators to urge opposition to this legislation.
